These terms govern access to and use of the Centhylon online store and purchases made through www.centhylon.com.
PLEASE READ THESE TERMS CAREFULLY
These General Terms expressly govern the relationships arising between MeditBlue S.L., Plaça Joan Serrats, nº3 Local C, Martorell (BARCELONA), 08760, with CIF B65769721 (hereinafter, “MeditBlue, S.L.”), and third parties (hereinafter, the “Users”) who register as users and/or purchase products through the online store of MeditBlue, S.L.’s official website (http://www.centhylon.com, hereinafter, the “Store”).
2. USER OBLIGATIONS
2.1 The User undertakes, in general, to use the Store, purchase Products, and use each of the Store’s services diligently, in accordance with the law, morality, public order, and these General Terms. The User must also refrain from using them in any way that may prevent, damage, or impair the normal operation and enjoyment of the Store by other Users, or that may harm or cause damage to the assets and rights of MeditBlue, S.L., its suppliers, Users, or, in general, any third party.
3. PRODUCTS AND PRICES
3.1 MeditBlue, S.L. reserves the right to decide, at any time, which Products are offered to Users through the Store. In particular, MeditBlue, S.L. may at any time add new Products to those offered or included in the Store; unless otherwise stated, such new Products shall be governed by these General Terms. Likewise, MeditBlue, S.L. reserves the right to discontinue or restrict access to and use of any of the different categories of Products offered in the Store, at any time and without prior notice.
3.2 The Products included in the Store will match as faithfully as possible—within the limits of web display technology—the Products actually offered. The characteristics of the Products and their prices appear in the Store. The prices indicated in the Store are in Euros and do not include VAT, unless otherwise stated.
4. PROCEDURE AND PAYMENT METHOD FOR PRODUCTS
4.1 Within a maximum period of twenty-four (24) hours, MeditBlue, S.L. will send an email to the User confirming the purchase. This email will assign a purchase reference code and will detail the Product’s features, its price, shipping costs, and information about the different payment options available to pay MeditBlue, S.L. for the Products.
4.2 The User purchasing a product through the Store must make payment using the payment systems specifically detailed in the Store.
4.3 MeditBlue, S.L. will keep the electronic documents in which the contract is formalized and will send a copy to the User once the purchase has been made. The contract will be concluded in Spanish.
4.4 The order confirmation sent by MeditBlue, S.L. is not valid as an invoice; it is only proof of purchase. MeditBlue, S.L. will send the corresponding invoice with the Product.
5. RIGHT OF WITHDRAWAL
5.1 The User has a right of withdrawal and may contact MeditBlue, S.L. by email at info@centhylon.com to withdraw from the purchase within a period not exceeding fourteen (14) business days, counted from receipt of the Product. The Product must be returned together with the return form duly completed and a copy of the delivery note or invoice, duly completed. Shipping will be at the customer’s expense. Meditblue SL will facilitate the option to arrange transport, with the cost borne by the customer. The return will be carried out in accordance with the instructions provided by MeditBlue, S.L. in response to the User’s notification of withdrawal. The User must return the Product within a maximum of fourteen (14) days from the date MeditBlue, S.L. indicates the return procedure.
5.2 Withdrawal entails a refund of the amount paid. To that end, the customer must indicate on the return form the number and cardholder name of the credit card to which MeditBlue, S.L. must issue the refund. The refund period will be as established by law.
5.3 The right of withdrawal may not be exercised if the Product is not returned in its original packaging and if the Product is not in perfect condition.
6. CUSTOMER SERVICE
6.1 For any incident, claim, or exercise of rights, the User may send an email to info@centhylon.com.
7. HOME DELIVERY
7.1 The territorial scope of sales through the Store is exclusively limited to the territory of the European Union, so the delivery service will be provided only within that territory. Products purchased through the Store will be shipped to the delivery address indicated by the User once payment is verified, with a maximum delivery period of thirty (30) days as established by law by default.
7.2 MeditBlue, S.L.’s delivery service is carried out in collaboration with various well-known logistics operators. Orders will not be delivered to PO boxes or to hotels or other non-permanent addresses.
7.3 Shipping costs are not included in the Product price. At the time of purchase, the User will be informed of the exact shipping cost.
8. INTELLECTUAL AND INDUSTRIAL PROPERTY
8.1 The User acknowledges that all elements of the Store and of each of the Products, the information and materials contained therein, trademarks, the structure, selection, arrangement and presentation of their contents, and the computer programs used in connection with them are protected by intellectual and industrial property rights belonging to MeditBlue, S.L. itself or to third parties, and that these General Terms do not grant the User any rights other than those expressly contemplated herein.
8.2 Unless authorized by MeditBlue, S.L. and/or the relevant third-party rights holders, or unless legally permitted, the User may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, lend, make available, or allow public access through any form of public communication of any of the elements referred to in the preceding paragraph.
The User must use the materials, elements and information accessed through use of the Store only for their own needs and undertakes not to carry out, directly or indirectly, any commercial exploitation of the materials, elements and information obtained through the Store.
8.3 The User must refrain from circumventing or manipulating any technical devices established by MeditBlue, S.L. or by third parties in the Store.
9. DATA PROTECTION
9.1 In compliance with Spanish Law 15/99 (LOPD), we inform you that your personal data and other information provided through the registration form, as well as that arising from transactions carried out, will be included and kept in a file for processing, owned by MeditBlue, S.L., until deletion is requested. Processing will be aimed at developing and executing the sale, providing personalized attention regarding the products and services you purchase and improving such attention, as well as promoting MeditBlue, S.L.’s own products and services and those of third-party companies linked to MeditBlue, S.L.
9.2 The User may exercise at any time the rights of access, rectification, objection or cancellation by writing to MeditBlue, S.L., Plaça Joan Serrats, nº3 Local C, Martorell (BARCELONA), 08760 or by email to info@centhylon.com, attaching a copy of their N.I.F. or substitute identification document.
9.3 Fields marked with * in the registration form are mandatory. Failure to complete them will prevent the purchase of the selected products.
10. PASSWORDS
10.1 MeditBlue, S.L. provides personal passwords to users who register on the website. These passwords allow access to services provided through the Website. The user must keep their passwords strictly confidential and assumes all liability for any damages or consequences arising from breach or disclosure of secrecy. For security reasons, the telematic access password to services linked to the Website may be changed at any time by the user. The User undertakes to notify MeditBlue, S.L. immediately of any unauthorized use of their password, as well as access by unauthorized third parties.
11. COOKIES
11.1 MeditBlue, S.L. uses cookies to improve its services, facilitate navigation, maintain security, verify the User’s identity, provide access to personal preferences, and track use of the Store. Cookies are files installed on the hard drive of the User’s computer or in the browser memory in the folder preconfigured by the operating system to identify the User.
11.2 If the User does not wish a cookie to be installed on their hard drive, they must configure their internet browser not to receive them. Likewise, the User may delete cookies freely. If the User decides to disable cookies, service quality and speed may decrease and they may lose access to some services offered in the Store.
12. APPLICABLE LAW AND JURISDICTION
These general terms are governed by Spanish law. Any dispute arising from interpretation or execution that may arise in relation to the validity, interpretation, performance or termination of this contract will be submitted to the jurisdiction and competence of the Courts and Tribunals of the City of Martorell, with waiver of any other jurisdiction that may correspond to the User, insofar as the applicable legislation permits.
Warranty Coverage and Product Conformity
This document describes the statutory legal warranty of conformity applicable to online purchases of diffusers, fragrances and air fresheners on www.centhylon.com, as well as (where applicable) any additional commercial warranty that Meditblue, S.L. may offer.
This document does not limit the rights granted to consumers by applicable law.
1. Scope
1.1. Covered products
Applies to products purchased on www.centhylon.com and sold by Meditblue, S.L., including, by way of example:
- Diffusers (electric, nebulizers or others).
- Fragrances (for home and/or business) and refills.
- Air fresheners (sprays, reed diffusers, refills, etc.).
1.2. Customer types: individuals vs. businesses
- Individual customers (consumers and users): the statutory legal warranty of conformity applies (sections 3 to 9).
- Business/professional customers (B2B): section 10 applies, unless otherwise agreed in writing or required by mandatory law.
1.3. Territorial scope (European Union)
- For purchases delivered in Spain or consumers habitually resident in Spain, the time limits and rules in this document apply.
- For consumers habitually resident in other EU Member States, mandatory rules of their country of residence may apply. In any case, Meditblue, S.L. provides coverage aligned, at a minimum, with European standards of conformity.
2. Key concepts (definitions)
- Statutory legal warranty (conformity): the seller’s obligation to deliver goods that conform to the contract and to be liable for any lack of conformity that becomes apparent within the legal period.
- Lack of conformity: when the product does not match what was agreed (description/quantity/quality), does not work or is not fit for ordinary use, or presents defects/malfunctions not attributable to external causes.
- Remedies: solutions provided by law: repair or replacement and, where appropriate, a price reduction or termination (refund against return of the product).
- Commercial warranty (additional): a voluntary extra commitment (e.g., “extended warranty”) that can never reduce the statutory legal warranty.
3. Statutory legal warranty for consumers (Spain): duration and time limits
3.1. General period (goods)
For contracts concluded from 1 January 2022, the seller is liable for lack of conformity that becomes apparent within 3 years from delivery.
3.2. Second-hand goods (if sold)
For second-hand goods, a shorter period may be agreed, but never less than 1 year.
Default period set by Meditblue, S.L. for second-hand (if applicable): 1 year, unless otherwise established in writing within legal limits.
3.3. Presumption of pre-existence of the defect (burden of proof)
If the lack of conformity becomes apparent within 2 years of delivery, it is presumed—unless proven otherwise—to have existed at the time of delivery (with nuances depending on the nature of the goods or the defect).
3.4. Reporting the issue
It is recommended to report the issue as soon as possible after it is detected. For practical purposes, it is recommended to do so within 2 months from when it became known.
4. What the statutory warranty covers (practical examples)
The statutory warranty covers, among others, the following situations when they constitute a lack of conformity:
4.1. Diffusers
- The diffuser does not turn on, does not diffuse/nebulize properly, or turns off abnormally without an external cause.
- Manufacturing defects, defective internal components, assembly errors.
- The product received does not match the model or features offered.
4.2. Fragrances and air fresheners (consumables)
- The product arrives damaged, with leakage attributable to a defect in the original container or outbound packaging.
- Order preparation error (different fragrance, incorrect format, wrong quantity).
- Manufacturing defect of the container or closure/dosing system that prevents normal use.
Note: For consumables, conformity is assessed especially with regard to integrity, quantity, identification, safety, condition and fitness for use at the time of delivery.
5. What is NOT covered (common exclusions)
Unless it constitutes a lack of conformity, the warranty does not cover:
- Improper use or use contrary to instructions.
- Damage from impacts, drops, humidity/overheating, power surges, defective electrical installations or force majeure.
- Normal wear and tear, consumption, evaporation and expected reduction due to use (e.g., consumables).
- Subjective changes in scent perception, intensity or personal preference that do not imply a product defect.
- Lack of reasonable maintenance (e.g., not cleaning the diffuser when the manual indicates it).
- Products modified or repaired by unauthorized third parties.
5.1. Use of nebulization-suitable fragrances (nebulizing diffusers) and impact on the warranty
Nebulizing diffusers are designed to use fragrances specifically formulated for nebulization according to technical specifications (e.g., volatility, absence of residues/sugars/non-suitable oils, compatibility with seals and components, etc.). Using incompatible liquids can cause clogs, deposits, corrosion, seal degradation or other damage.
- The statutory warranty covers lack of conformity of the diffuser not caused by improper use or incompatible liquids.
- Damage or failures caused wholly or partially by the use of third-party fragrances/liquids or liquids of any origin will be excluded when it is determined that they are incompatible or caused the issue.
Diagnostic information: To process a claim, Meditblue, S.L. may request reasonable information for diagnosis, for example:
- Identification of the liquid used (brand/model), and the technical/safety data sheet if available.
- Where necessary, inspection of the device to verify residues/clogging.
If the diagnosis concludes that the failure is attributable to the use of an incompatible liquid, the repair may be offered out of warranty, by quotation. In no case do these conditions limit the consumer’s rights under applicable law.
6. Remedies when there is a lack of conformity (order and criteria)
6.1. Bringing the product into conformity: repair or replacement
When the product is not in conformity, the consumer has the right to request that it be brought into conformity and may choose between:
- Repair, or
- Replacement,
unless one of these options is impossible or disproportionate.
6.2. Free of charge and “reasonable time”
Repair or replacement:
- Will be free of charge (including necessary costs to bring the product into conformity, especially shipping/transport, labor and materials).
- Will be carried out within a reasonable time and without major inconvenience to the consumer.
6.3. Price reduction or termination
If repair or replacement is not possible or is not carried out properly, the consumer may request:
- A price reduction, or
- Termination of the contract (refund),
taking into account that termination does not apply if the lack of conformity is minor.
7. Costs, collection and logistics (B2C)
7.1. Issues covered by the statutory warranty
When the issue is a lack of conformity, bringing the product into conformity (repair or replacement) will be free of charge to the consumer, including necessary costs, especially shipping/transport, labor and materials.
7.2. Shipping/collection options
For processing we may offer, depending on the case:
- Home collection, or
- A prepaid label for drop-off at a point.
In any case, if the issue is covered by the statutory warranty, these arrangements will be at no cost to the consumer and organized to minimize inconvenience.
7.3. Issues not covered (out of warranty)
If, after technical review, it is determined that the issue is not a lack of conformity but is due to external causes (e.g., misuse, liquids incompatible with nebulization, tampering, impacts, liquid ingress, power surges, lack of maintenance, etc.), the intervention will be considered out of warranty. In that case:
- We will issue a brief diagnostic report and a quotation (which may include collection, diagnosis, repair and return shipping).
- Repair will be performed only after express acceptance of the quotation.
- If the customer does not accept the quotation, they may request return of the product unrepaired, assuming return transport costs and, if previously informed, a diagnostic fee (if applicable).
8. Warranty claim procedure (step by step)
8.1. How to start a request
To process an issue, contact info@centhylon.com stating:
- Order / invoice number.
- Affected product (model, format, quantity).
- Description of the problem and when it was detected.
- Photos and/or video (highly recommended), especially if there are damages, leaks, breakage or operating issues.
- Contact address and phone number (if collection is required).
8.2. Initial verification
Meditblue, S.L. may request additional information to:
- Identify batch or serial number (if applicable).
- Verify usage/maintenance instructions.
- Determine the fastest solution (replacement, repair, etc.).
8.3. Packaging
It is recommended to keep the original packaging or package appropriately to avoid damage during transport.
8.4. Resolution
- Once lack of conformity is verified: repair or replacement will be performed or, where applicable, price reduction/termination.
- If it is concluded that there is no lack of conformity (e.g., damage due to misuse), the customer will be informed with an explanation and, where appropriate, options for quoted repair or replacement.
9. After-sales service and spare parts (durable goods)
For durable goods (e.g., certain diffusers), the consumer is entitled to adequate technical service and to the availability of spare parts for 10 years after the product ceases to be manufactured (with transitional rules for products prior to 01/01/2022). If a product is not a durable good (e.g., refills, fragrances or consumable air fresheners), this section may not apply.
10. Conditions for business/professional customers (B2B)
When the purchase is made within the scope of a business or professional activity:
- The relationship will be governed by civil/commercial regulations and by what is agreed in specific terms or contract.
- Standard B2B warranty: unless otherwise agreed in writing, Meditblue, S.L. offers a limited 12-month warranty for diffusers against manufacturing defects, with exclusions similar to those in section 5.
- For consumables (fragrances/air fresheners), B2B coverage is limited to incorrect product, delivery damage or original container defect detected within 15 days of receipt.
11. Additional commercial warranty (if offered)
If Meditblue, S.L. offers a commercial warranty (e.g., “extended warranty” or “extra coverage”), it:
- Is additional and does not affect the statutory warranty.
- Will clearly indicate: the guarantor, the procedure, the covered goods, conditions, duration and territorial scope.
12. Dispute resolution and consumer assistance
- If an issue arises, we will try to resolve it amicably via info@centhylon.com.
- Consumers may contact public consumer services (OMIC / regional bodies) or support networks for cross-border disputes (e.g., European Consumer Centres).
- EU note: the European ODR platform is no longer operational for new complaints.
13. Applicable law and jurisdiction
- If the buyer is a consumer, the applicable mandatory consumer protection rules will apply and, where appropriate, the competent courts will be determined in accordance with those rules.
- For B2B transactions, unless mandatory rules apply, Spanish law will apply and the parties submit to the courts and tribunals of Barcelona, unless otherwise agreed.
14. Changes to this coverage
Meditblue, S.L. may update this document to reflect operational improvements or regulatory changes. The current version will be the one published on www.centhylon.com.
